TERMS AND CONDITIONS

It is first specified that the conditions manage the sales of art works and other products presented on www.olschinsky.at and www.nevertheless.at. These terms are the only ones that can be applicable. Deviations from these conditions are only effective if confirmed in writing. If one of these terms and conditions is invalid, the remaining provisions stay unaffected. In this case the parties undertake to replace the invalid provision with a regulation that comes as close as possible to the economic intent of the ineffective provision.

§ 1. THE CUSTOMER

To be a customer of the website you must be a consumer of legal age and with full legal capacity or to be authorized by your parents. The personal information given to atelier olschinsky upon any order you may place must be complete, accurate and up to date. atelier olschinsky would not be responsible for undelivered products should the data prove incorrect.

§ 2. PRICING

Prices are indicated in Euros (EUR) and all taxes are included except customs taxes. Shipping costs amount to EUR 9.00 (Austria) / EUR 15.00 (European Union) / EUR 25.00 (other countries). In case you order from another country than Austria you are the importer of the concerned products. For every products shipped out of the EU, the price will be calculated with the VAT included referring to the Austrian law. Some custom taxes can be asked by the customs of the country of destination depending on the legislation of that country. atelier olschinsky cannot be held responsible for these taxes. You will be charged in addition to the amount you will have already paid to atelier olschinsky. We advise you to get in touch with your local authorities in order to get more information. All the orders must be paid in Euros (EUR). atelier olschinsky can change some prices at any moment but the products will be invoiced on the basis of the prices displayed during the recording of the orders.

§ 3. ORDERING

On internet: www.olschinsky.at and www.nevertheless.at The acceptance of orders placed on the website is subject to compliance with the procedure set up by atelier olschinsky. This takes the form of a series of succeeding screen pages indicating the steps to be taken by customers to validate their order. You will have the possibility, before final validation of your order, to verify your order details and the total price, and to correct any possible errors, before confirming it and expressing your acceptance. Every confirmed order applies as a sale contract and an acceptance of all the present stipulations. Once you have validated your order, atelier olschinsky will promptly confirm receipt by sending you an e-mail to the address provided to us. In that aim, you formally accept the use of e-mail by atelier olschinsky to confirm the content of your order. This confirmation e-mail will include all of the information provided by you, as well as the accepted price and terms of payment.

§ 4. CONFIRMATION

By clicking the button 'checkout' after the ordering process, you declare that you accept fully and without any reserve your order including the totality of the General Terms of Sales. The recorded data on www.nevertheless.com is a proof for the totality of the transactions done by atelier olschinsky and its customers.

§ 5. PAYMENT

All payments are done either through the secure payment tool provided by mpay24 or through the Paypal service. Therefore neither exchange nor refunds are essential.

§ 6. SHIPMENT AND DELIVERY

Products will be packed and shipped whithin 3 to 5 working days and are delivered to the delivery address indicated during the order process. In case of unusual delay you will receive an e-mail. We take greatest care in packing and shipping artworks. Every art work bought, made from paper, is sent in a postal tube. Shipping route and shipping material are left to our choice. In the territories outside the European Union, it is recalled that delivery may be delayed for so long as customs formalities and duties have not been carried out or paid by you, and you agree to this. atelier olschinsky cannot be held responsible for the delays. In case of damaged delivery, the customer is due to notify the transport service and atelier olschinsky, by any means, its refusal of the product within 3 days following the delivery.

§ 7. AUTHENTICITY

atelier olschinsky assure customers the authenticity of ordered illustrations signed by the artist.

§ 8. RESPONSIBILITY

The products offered on www.olschinsky.at and www.nevertheless.at comply with the Austrian Law. It belongs to you to check with your local authorities your right to import the products you want to buy. The pictures and the texts presenting the products are not contractual. As a result, atelier olschinsky‘s responsibility could not be engaged in case of mistake in one of these photos or texts. atelier olschinsky cannot be responsible for the non execution of the contract in case of end of stock or unavailability of the product, major force, disturbance or complete strike or restricted postal service and means of transport and communication, flooding, fire. atelier olschinsky will not engage any responsibility for any indirect damages, loss of exploitation, loss of benefit, loss of chance, damage or fees. The present contract is submitted to Austrian Law. The language of the contract is in English. In case of trouble only the Austrian court will be compliant.

§ 9. PRIVACY

atelier olschinsky will not transfer the private information communicated. This information is confidential. It will be used only to treat your orders.

§ 10. COPYRIGHT

All the text, magazines, illustrations and images reproduced on the website www.olschinsky.at or www.nervertheless.at are worldwide reserved to the title of copyrights. To that title and according to the disposals of the Intellectual Property Code, only private use is allowed and that under reserve of some more restrictive disposal of the Intellectual Property Code. Every other use can be considered as falsification and punished according to the Intellectual Property Code except for prior atelier olschinsky agreement.

§ 11. CANCELLATION OF ORDER

Any cancellation of order of must be effected online by e-mail to office@olschinsky.at If the order has not been shipped at the time of cancellation, the whole payment will be refund immediately. If you decide to send any goods back, please inform us by e-mail and send your delivery directly to atelier olschinsky. The address can be found on the added bill or on Internet at www.olschinsky.at. The whole amount will be refund as soon as the delivery has arrived at atelier olschinsky in a proper and unused condition. The shipping costs of returned packages have to be paid by the customer.
